Special Provisional Use

Special Provisional Uses are to be reviewed by the Planning and Zoning Commission and submitted to the Board of Adjustment for final approval.  The process involves finding the use requested, consulting with the Zoning Administrator, comparing the proposed use with the Zoning regulations for the proposed location and issuing necessary permits prior to allowing said use.  

The Waverly Zoning Code allows for special provisional uses within specified zoning designations outlined in Section 100.21.09 of the City Code.  Approval of a special provisional use expires after 1 year unless a building permit and site plan have been approved by the City of Waverly.  The special provisional use goes with the land, not ownership.  The ownership may change and not require a new special provisional use if the use remains the same.

In the event that there are changes that need to be applied to the original approved Special Provisional Use Application, a Special Provisional Use Amendment Application will need to be submitted and approved through the same process as the original application.

There is no fee for a special provisional use.
